These Terms and Conditions (the “Terms”) govern your use of menesmerch.com (the “Site”) and any purchase of products or services from Menes Technologies LLC d/b/a Menes Merch (“we,” “us,” or “our”). By accessing the Site or placing an order, you agree to these Terms together with our Privacy Policy, Shipping Policy, Return & Refund Policy, and Disclaimer, each of which is incorporated by reference.

If you do not agree with these Terms, please do not use the Site. We may update these Terms at any time; the version posted on the Site at the time of your order applies to that order.

1. Eligibility and Accounts

You must be at least 18 years old (or the age of majority in your jurisdiction) to make purchases. If you create an account, you are responsible for keeping your credentials confidential and for all activity under your account. Provide accurate and complete information and keep it up to date.

2. Products and Services

We sell merchandise and may offer related products and services. Some products are custom-made to order through print-on-demand production partners; others may be stocked, digital, or service-based offerings added from time to time. Product descriptions, images, and colors are provided for illustration — because many items are made to order, minor variations in color, placement, and sizing may occur and are not defects.

We reserve the right to modify, limit, or discontinue any product or service at any time without notice, and to limit quantities or refuse orders at our discretion.

3. Orders, Pricing, and Payment

  • All prices are shown in U.S. dollars and may change without notice.
  • Placing an order constitutes an offer to purchase. A binding contract forms when we accept your order, which we may confirm by email.
  • We may cancel or refuse any order (for example due to pricing errors, suspected fraud, or stock/production issues). If we cancel after payment, you will receive a full refund to your original payment method.
  • Payment is processed securely by third-party processors. You authorize us to charge the payment method provided for the full order total, including applicable taxes and shipping.
  • You are responsible for any applicable sales tax, duties, or customs charges.

4. Made-to-Order Production

Many of our products are produced on demand after your order is placed. Once production begins, orders generally cannot be canceled or modified. Estimated production and delivery times are provided in our Shipping Policy and are estimates, not guarantees.

5. Shipping and Risk of Loss

Shipping terms are described in our Shipping Policy. Risk of loss and title pass to you upon delivery to the shipping carrier, to the extent permitted by law.

6. Returns and Refunds

Returns, exchanges, and refunds are governed by our Return & Refund Policy, available on the Site.

7. Intellectual Property

All content on the Site — including designs, artwork, logos, text, graphics, and software — is owned by or licensed to us and protected by intellectual property laws. You may not copy, reproduce, resell, or exploit any content without our prior written consent. Purchasing a product grants you ownership of the physical item only, not any rights in the underlying design.

8. Acceptable Use

You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms.
  • Interfere with the Site’s security or operation, or attempt unauthorized access.
  • Submit false, misleading, or fraudulent information or orders.

We may suspend or terminate accounts and refuse service for violations of these Terms, without refund where prohibited conduct is involved.

9. User Content and Reviews

If you submit reviews, photos, or other content, you grant us a non-exclusive, royalty-free, perpetual license to use, display, and reproduce that content in connection with our business. You represent that you own or have rights to anything you submit.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SITE, PRODUCTS, OR SERVICES IS LIMITED TO THE AMOUNT YOU PAID FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

13. Indemnification

You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or misuse of the Site, products, or Services.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Wyoming, and the parties consent to their jurisdiction, except that either party may bring an individual claim in small claims court.

15. General

If any provision of these Terms is found unenforceable, the remainder stays in effect. Our failure to enforce a right is not a waiver. These Terms, together with the policies referenced above, are the entire agreement between you and us regarding the Site.
